Privacy Policy and Terms

Prowedian (“we,” “us,” “our”) works hard to build and maintain a relationship of trust with you. This Privacy Policy (the “Privacy Policy”) governs our collection, use, and disclosure of your Personal Information (as defined below) in connection with your use of our App Prowedian or website on which this Privacy Policy is linked (the App), such as www.prowedian.com and any services, transactions, or other engagements you might have with us including your use of our applications (collectively, “Services”).

This Privacy Policy explains what information we collect about you, how we use or disclose such information, how to exercise any rights you may have with respect to your Personal Information (including any rights to opt-out of certain uses of your information), and the safeguards we have in place to reduce the risk of unauthorized access and use. This Privacy Policy does not apply to the Personal Information (defined below) of our employees, independent contractors, and job applicants.

Please carefully read this Privacy Policy, which is part of our Terms of Service, before using our App and/or Services. If you do not agree with our Terms of Use or this Privacy Policy, you must refrain from using our App/Services. By accessing or using our App or Services, you agree to our use of your information consistent with our Terms of Use and this Privacy Policy.

Privacy Policy changes

This Privacy Policy is subject to change. We encourage you to review this Privacy Policy frequently for any revisions or amendments. Changes to this Privacy Policy will be posted on the App and will be effective immediately upon posting. You will be deemed to have been made aware of and have accepted the changes by your continued use of our App or Services. If we determine that a change to this Privacy Policy will result in using your Personal Information acquired before the change being used in a materially new way, we will provide you notice before using your Personal Information in the new way such as by sending you an email, posting a notice on our App, or sending a notice through our applications.

Conflict between this Policy and laws and regulations

When federal, state, or local laws and regulations require a higher level of protection for your Personal Information, they take precedence over this Privacy Policy. The specific requirements of this Privacy Policy apply unless disallowed by applicable laws or regulations.

We collect information that personally identifies, relates to, describes, or is capable of being associated with you (“Personal Information”), including:

The specific Personal Information we collect about you may vary based on how you use the App and/or Services and your relationship with us such as if you are a user of our products or if you are a contact person for a company with which we do business.

User-Created Data

When using our Services, you may create data such as calendars, address, events, tasks, and more that we refer to in this Privacy Policy as “User-Created Data”. User-Created Data should be kept on-device and Firebase/Firestore database. We also believe that it is important for our users to understand how their User-Created Data is handled.

Firebase services

We utilize Firebase services to enhance the functionality of our applications and improve user experience. Firebase is a platform developed by Google that provides various tools and services for app development. When you use our Services, Firebase may collect certain information automatically, including:

Firestore database

Our applications may use Firestore, a NoSQL cloud database by Google, to store and retrieve certain types of data. Firestore allows us to create a seamless and responsive user experience. The data stored in Firestore may include User-Created Data as described in the “Information we collect” section.

Data security and access

We take appropriate measures to secure any data stored in Firebase or Firestore. Access to Firebase and Firestore is restricted to authorized personnel who need access for the purpose of maintaining and improving our Services. We implement industry-standard security practices to protect against unauthorized access, disclosure, alteration, and destruction of data.

AI features

Some features use artificial intelligence to save you time. When you choose to convert an inquiry into a lead — for example by pasting an email or uploading a screenshot — or to turn a client's schedule into an event timeline, the text or image you provide is sent to a third-party AI provider that processes it on our behalf to generate the structured result. This content is used only to produce the result you requested; it is not used for advertising. The AI assists you: you review and confirm every result, and no decision producing legal or similarly significant effects is made automatically. If the content you submit contains personal data of your clients, you are responsible for having a lawful basis to process it.

Maps, location and weather

To display maps, search for addresses and calculate distance, driving time and fuel costs, the event location and address data you enter is sent to the Google Maps Platform. To show the forecast for your event day, the relevant location is sent to our weather data provider. This data is used only to provide these features.

Subscriptions and payments

Subscriptions are sold and processed by Apple through the App Store. We do not receive or store your payment card details; Apple provides us only with your subscription status so that we can unlock the corresponding features in the App.

Usage analytics

We may collect analytics information about your use of the App in order to understand how it is being used so we can improve it. This data may be anonymized and therefore, if anonymized, is not considered Personal Information as defined in this Privacy Policy. You can limit analytics and tracking at any time through your device's privacy settings.

Communication recordings

We may retain the content of text messages or other written/electronic communications between you and us. By communicating with us, you consent to our recording and retention of communications.

How we collect information

Voluntary disclosure

We may ask you to provide us with Personal Information when you communicate with us (online or offline), use the App, purchase Services, and at other times. You are not required to provide us your Personal Information; however, if you choose not to provide the requested information, you may not be able to use some or all of the features of the App or Services or we may not be able to fulfill your requested interaction.

Cookies

The Prowedian app itself does not use cookies. Our website (prowedian.com) uses a single functional cookie that remembers the language you selected; it stores no Personal Information. Because this cookie is strictly necessary to provide the feature you requested, no cookie-consent banner is required. We do not use advertising cookies, tracking pixels, clear gifs or other tracking technologies, and we do not operate an affiliate program.

Additional United States privacy rights

The rights in this section are provided for residents of the United States. If you are located in the European Economic Area, the United Kingdom or Switzerland, your rights are described in the dedicated section below, which prevails for you.

You have the right to request twice per 12-month period that we provide you:

We are not permitted to provide access to specific pieces of Personal Information if the Personal Information is sensitive or creates a high risk of potential harm from disclosure to an unauthorized person such as payment method information. We will not provide specific pieces of Personal Information unless you expressly request them.

Right to deletion

You have the right to request that we delete any Personal Information we have collected about you. Please understand that we are not required to honor a deletion request if a legal exemption applies such as if we need the information to complete a requested or reasonably anticipated transaction, help ensure security, enable internal uses that are reasonably aligned with your expectations, or comply with legal obligations.

Right to correction

You may request that we correct information you believe to be inaccurate. When you make your request, please be sure to provide us with the specific information that you believe is inaccurate and the correct information. You should also provide us with any documentation you believe supports your proposed correction, and we will take that documentation into consideration. We will only correct the information if we determine, based on the totality of the circumstances, that your correction is more likely than not accurate. We may also choose to delete the allegedly inaccurate information instead of correcting it.

Right to appeal

You have the right to appeal our decision to deny, in full or in part, your exercise of privacy rights by submitting a request to appeal. If we deny your appeal, we will provide you with a written explanation of the reasons for our decision. If you are not satisfied with our explanation for the denial of your appeal, you may contact your state Attorney General to submit a complaint about the appeal results.

Submitting a request

You may submit your request(s) by email to info@prowedian.com

After you submit your request, we may contact you to obtain additional information necessary to verify your identity. For example, we may require you to verify certain information in our files or submit a signed declaration under penalty of perjury verifying your identity. We will not process requests without verifying your identity, so please respond promptly. If you do not timely respond to our requests for information, we may deny your request.

We will process verified Right to Know, Deletion, and Correction requests within 45 days of receipt, subject to any applicable exemptions and extensions permitted by law up to 90 days. We will process verified Appeals within the timeframe prescribed by applicable state law, but generally within 45 days of receipt. If you request access to specific Personal Information and that information creates a high risk of potential harm from disclosure to an unauthorized person, we will withhold that information and replace it with a category identifier and/or redacted information. Note that payments are handled by Apple through the App Store, so we do not hold your payment card details. We will provide the response to your request by email, or through your account where available. We will retain a copy of your request, including your deletion request, for at least two years as required by law.

Additional information for persons located in the European Economic Area, Switzerland, or the United Kingdom

Prowedian informs you below in accordance with Art. 12, 13 GDPR about the processing of personal data as well as about your respective privacy rights.

You will find a list of personal data processed by Prowedian in the sections “What personal information do we collect?”. The purpose of processing is to provide the Prowedian App and all functions of our specific services. In addition, Prowedian may process your location to provide weather forecasts and location-specific information. Prowedian also collects data about your use of Prowedian App in order to continuously develop and improve its services.

Legal bases for data processing

International data transfers

When you use Prowedian, some personal data is processed by service providers located outside the EEA, including Google (Firebase and Firestore for storage, Google Maps Platform for maps and distances), Apple (App Store subscriptions), our weather data provider and our AI provider. Where personal data is transferred to a third country, the transfer is safeguarded by the European Commission's Standard Contractual Clauses or an equivalent adequacy mechanism. Prowedian maintains comprehensive technical and organizational measures to protect your data.

Your data will be stored as long as you maintain your accounts. As soon as you delete data or your account, Prowedian will also delete your data from its servers. There may be short delays for technical reasons. We must retain certain data, such as invoices, for a longer period due to retention obligations under tax law.

Providing your data is neither legally nor contractually required. However, it is possible that Prowedian will not be able to provide you with its services or individual services if you do not provide certain data.

Automated decision-making, in particular profiling, does not take place.
